Please read the General Terms of Use carefully before you start using our electronic platform www.hommex.co (hereinafter: the Platform).
The General Terms of Use regulate the conditions for publishing listings for the sale and rental of real estate through the Platform, the rights and obligations of users, and other matters important for the functioning of the Platform within VORTEK INOVATIONS D.O.O. Skopje, a trade and services company, with its registered office at Njudehliska 6/1-13, Karposh, Skopje, North Macedonia, e-mail address: hello@vortec.io, entered in the Trade Register and the register of other legal entities under EMBS 7757832, TAX ID MK4057024570335 (hereinafter: "VORTEK INOVATIONS, the Company, the platform, or We").
By using the Platform, you agree to the General Terms of Use and confirm that you have read, understood and accepted them. The Terms of Use are based on the Law on Obligations, the Law on Consumer Protection, the Law on Personal Data Protection and other regulations in force in the Republic of North Macedonia.

Any adult natural person has the right to create a user account on the Platform. Registration may be performed in the following ways: by entering an e-mail address and going through the verification process, or by connecting with a Google, Facebook or Apple account.
When registering via e-mail, a verification message is sent to the entered e-mail address. The validity of the confirmation link is 24 hours. After confirming the e-mail address, the user completes the creation of the profile by entering: first name, last name, date of birth and phone number.
The user is responsible for the accuracy of all entered data. When publishing a listing, the e-mail address and phone number become publicly visible so that interested persons can contact the advertiser.
Any business that is a registered taxpayer in the Republic of North Macedonia or outside of it has the right to create a user account. When creating a business account, the following data must be entered: name of the legal entity, phone number and tax number. The stated tax number is not publicly displayed in the published listings.
The user is responsible for keeping the security of their account, including the password and access credentials. The user should not share the password with third parties. VORTEK INOVATIONS bears no responsibility for unauthorised access to the user account caused by the user's negligence.
The Platform maintains a list of active authenticated sessions for each user, viewable from the account security page. For each session the following are shown: device, approximate location and time of last activity. The user may remotely sign out of any active session.
When a sign-in occurs from a device not previously seen for the account, a security notification email is sent to the verified email address. Additionally, a confirmation email is sent on every password change.
Inactive sessions automatically expire after 60 days for the web client and after 365 days for the mobile applications.

Published listings must comply with the applicable legal regulations of the Republic of North Macedonia, the regulations of the respective industry and the Platform's policy.
Listings are automatically published upon completion of the creation process, without prior manual review and approval by the administrators. However, the Platform applies automated moderation of images (described in Section 4) and reserves the right to perform additional checks and to delete listings that do not comply with the policy.
The real estate for which the listing is published is also displayed on an interactive map.
VORTEK INOVATIONS reserves the right to delete a published listing that violates the above rules, without issuing a refund of spent funds. If the advertiser has spent funds on publishing multiple listings and a problem arises with one of them, the advertiser has no right to request a refund for the other listings.
The Platform reserves the right to decide when a listing is classified as a listing from a natural person versus a listing from a business.
The Platform applies automated moderation of images uploaded to listings, with the aim of ensuring a safe and appropriate environment for all users. Images are automatically analysed for detection of inappropriate material, including adult content, violence, weapons and other prohibited material.
If the automated system determines that a particular image violates our policy, it will be rejected and will not be published. This analysis does not include identification of persons. If you believe that your image has been unjustifiably rejected, you may request a manual review via our customer support team by e-mail: hello@hommex.co.

All images and videos published on the Platform are marked with the Hommex watermark, in order to prevent their misuse outside the Platform. VORTEK INOVATIONS reserves the right to remove images and video clips that violate the above rules.
Registered users have the option to manage their listings via the user profile. The available listing statuses are:
The user may delete their listing at any time. Upon deletion, all data and images associated with the listing are permanently removed, including the automatically generated translations into other languages (see Section 19).
The Platform allows registered users to communicate with one another via an internal messaging system. Messages may be sent in connection with a specific listing, in which case the advertiser receives an e-mail notification about the new message.
Users undertake to use the messaging system exclusively for communication related to listings and real estate. It is not allowed to use the messaging system for sending spam, advertising messages, threatening or offensive content, or for any other misuse.
VORTEK INOVATIONS assumes no responsibility for, and has no access to, the content of private communication between users, except in cases where it is requested by a competent authority in accordance with applicable legislation.
Every user or visitor has the right to report a listing or user account that violates the Platform's rules. Reporting may be carried out via the appropriate function on the Platform by stating the reason for the report.
VORTEK INOVATIONS reviews the reports and reserves the right to take appropriate measures, including deletion of the listing, deactivation of the user account or restriction of access to the Platform.

The Platform offers subscription plans that provide users with additional features and benefits. The specific features, prices, renewal, cancellation and refund conditions of the subscription plans are described in detail in our Subscription Policy.
By subscribing to any plan, the user confirms that they have read, understood and accepted the conditions contained in the Subscription Policy.
VORTEK INOVATIONS D.O.O. Skopje, a trade and services company, with TAX ID MK4057024570335 and EMBS 7757832, is a VAT payer.
Payments on the Platform are made by payment card (VISA or MasterCard). All transactions are processed through the payment processing system of Halk Bank AD Skopje, which is certified by VISA and MasterCard for transaction processing. During payment, the HTTPS security protocol and Secure Socket Layer (SSL) technology are used to protect data. We have no insight whatsoever into your payment card data (card number, security code or your account balance).
Any business that is a registered user may also make payment by invoice in addition to payment card. For this, you need to contact the customer support team by e-mail: hello@hommex.co.
After payment has been made for publishing a listing, we do not refund the spent funds, except in cases provided for by applicable legislation.
For refunds related to subscription plans, the conditions set out in the Subscription Policy apply.
All content on the Platform, including the design, logo, graphic elements, software and database, is the intellectual property of VORTEK INOVATIONS or is used under an appropriate licence. Unauthorised copying, distribution or use of this content is forbidden and subject to legal liability.
By publishing a listing, the advertiser confirms that they have the right to use all content (text, images, videos) included in the listing and that its publication does not infringe the rights of third parties. The advertiser grants VORTEK INOVATIONS a non-exclusive right to display, store, process and translate the listing content into other languages for the purpose of providing the service (see Section 19).
All images and videos published on the Platform are marked with the Hommex watermark, in order to prevent their misuse outside the Platform.
www.hommex.co does not endorse the views and opinions published on the pages to which links placed by users lead.
VORTEK INOVATIONS bears no responsibility for the real estate that is the subject of the listing. Sellers and buyers themselves bear full responsibility for transactions executed between them. The Platform serves exclusively as an intermediary for connecting advertisers and interested persons.
VORTEK INOVATIONS does not guarantee the accuracy, completeness or timeliness of the information contained in the listings. Users are responsible for the accuracy of the data they enter.
VORTEK INOVATIONS will make reasonable efforts to ensure uninterrupted availability of the Platform. However, we do not guarantee that the Platform will be available without interruptions, errors or technical issues. We bear no responsibility for damages incurred due to temporary unavailability of the Platform or technical issues.
The user may change the data in their user profile at any time via the account settings.
The user has the right to request permanent deletion of their account. Upon account deletion, all personal data, listings (including all images, files and automatically generated translations associated with them), messages, saved favourite listings, saved searches and subscriptions associated with the account are permanently removed. This action is irreversible.
Account deletion does not imply any compensation for active subscription plans. Financial data related to executed transactions may be retained in accordance with applicable tax and accounting legislation.
The Platform offers Premium subscription plans that provide users with additional features. A detailed overview of Premium features, including their descriptions and benefits, is available on our Premium page.
For the conditions on payment, renewal, cancellation and refund of subscription plans, we refer you to our Subscription Policy.
One of the Premium features is Competitor Analysis. Subscribed users who hold this feature, as well as administrators, may view a summary of the engagement of any listing on the Platform — the number of views and contacts in the last 30 days, the current number of favourites, and the number of days the listing has been published. Conversely, the corresponding aggregate metrics of your own listings become visible to other users who hold this feature. The owner of a listing always sees the performance of their own listings. These are aggregate figures and do not reveal the identity of the persons who generated them. For details on the processing of this data, we refer you to our Privacy Policy.
The Platform allows registered users to save criteria for searching real estate. The system periodically (every 30 minutes) automatically checks whether new listings matching the saved criteria have appeared and notifies the user via push notification, e-mail and/or in-app notification, depending on the configured notification preferences.
The user may manage notification preferences (messages, saved searches, statistics) via their account settings. The user may delete saved searches at any time.
The Platform allows the creation of an agency profile which may contain one or more agents (sub-users). The agency is responsible for managing its agents and their listings.
When an agent is deleted, the listings associated with that agent remain active, and the contact information is automatically replaced with the agency's standard contact information.
Agencies have the option to access the Platform's API (programming interface) for automated management of listings. By activating API access, the agency confirms that it will use the interface responsibly, in accordance with these Terms, and that it will take appropriate measures for the security of the API keys. VORTEK INOVATIONS bears no responsibility for damage incurred due to unauthorised use of API keys by third parties caused by the agency's negligence. Misuse of API access may result in deactivation of access and/or the user account.
Subscribed users have access to Hommex AI — a feature for automatic generation or improvement of the title and description for listings with the help of artificial intelligence. The generated content is a suggestion and the user is fully responsible for reviewing, editing and publishing it.
In order to enable access to listings for users who speak different languages, the Platform automatically translates the titles and descriptions of published listings into our active languages (Macedonian, English, Serbian, Albanian) via the AI provider Anthropic (the Claude model). The original content always remains stored and visible, and translated versions are marked with the "Translated by Hommex AI" indicator.
As an advertiser, by publishing a listing you grant VORTEK INOVATIONS a non-exclusive right for your content (title and description) to be automatically translated and displayed to visitors of the platform in other languages. Visitors to the Platform have the option at any time to view the original (untranslated) version of the listing via an appropriate button on the listing page.
VORTEK INOVATIONS does not guarantee the accuracy, originality or appropriateness of AI-generated or AI-translated content. The user is responsible for ensuring that the published content is accurate, does not infringe the rights of third parties and complies with the listing rules set out in these Terms.
If you notice inaccuracies or issues with AI-generated or AI-translated content on your listing, you may contact our customer support team at hello@hommex.co.
Registered users have the right to rate the automatic translations of listings via a "thumbs up" or "thumbs down" button which is available on the page of each translated listing. The ratings are used exclusively for internal monitoring of the quality of translations and are not displayed publicly to other users.
The user may change or withdraw their rating at any time. The advertiser has no access to the individual ratings of their listings. For details on the processing of this data, we refer you to our Privacy Policy.
The Platform allows registered users and unauthenticated visitors to subscribe to our newsletter to receive information about new listings, tips and content from the platform.
Newsletter subscription is voluntary and is carried out by entering an e-mail address and giving consent. Every notification includes an unsubscribe link, and you may unsubscribe from the newsletter at any time via that link or by contacting our team at hello@hommex.co.

The platform allows registered users and unauthenticated visitors to keep track of listings they have previously viewed. The system automatically records when you visit a listing page and displays the "Recently viewed listings" list for easy return to them.
For registered users, the list is stored on their account and is available from all devices on which they are signed in. For unauthenticated visitors, the list is stored locally on their device (via the browser's "localStorage") and is not transferred to our servers. Upon first login, the local list is migrated to the user account.
In both cases, the list is limited to a maximum of 50 most recent records — older records are removed automatically. The user may at any time remove an individual record or delete the entire history.

Use of the Platform is available exclusively for adults (over 18 years of age). By registering and using the Platform, you confirm that you are of legal age and that you have the right to enter into contracts and make payments in accordance with applicable legislation.
VORTEK INOVATIONS reserves the right to make changes to these General Terms of Use at any time. Continued use of the Platform after the publication of the changes constitutes acceptance of the amended Terms.
The changes take effect upon publication on the Platform, unless otherwise specified.
These General Terms of Use are interpreted and applied in accordance with the laws of the Republic of North Macedonia. For all disputes arising from or related to these Terms, the competent court is the court in Skopje, Republic of North Macedonia.
Before initiating court proceedings, the parties will attempt to resolve the dispute by mutual agreement. The user has the right to submit a complaint to VORTEK INOVATIONS, which will be reviewed within 15 (fifteen) business days of receipt of the complaint.
